Terms & Conditions

By using services provided by Far & Low Travel, you (the client) are signifying your agreement with the following terms and conditions, on behalf of yourself and all members of your traveling party. Services provided include but are not limited to hotel bookings, excursion/activity bookings, transportation bookings, restaurant reservations, suggested free activities, etc.

Far&Low Travel will be referred to as “us, we, the travel agent, the travel advisor or Far&Low Travel” throughout this document.

The client will be referred to as “you, yourself, travelers, the client, party” throughout this document.

Check your documents

Please check your documents when you receive them.  You agree to review your itinerary and other travel documents for accuracy and to inform us promptly of any issues. The names on your documents must match your government-issued ID. It is your responsibility to contact us immediately if changes or corrections are required.  

Risks of Travel

We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov,  click on "Find International travel Information” then click on "Country Information", and  fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country.  It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of potential health hazards including but not limited to COVID-19. Ultimately it is your responsibility to understand and abide by all requirements and restrictions when traveling. This may include the following: health affidavit forms; health screenings prior to departure and/or upon arrival; temperature screenings prior to departure and/or upon arrival; travel reason affidavit forms; online travel authorizations; airline safety & health requirements, such as health forms, screenings, face coverings; in-country requirements, such as periodic temperature checks, quarantine, face coverings; visas. Failure to meet the requirements and/or restrictions puts you at risk for fines, quarantine or deportation at your expense. 


Travel Insurance

WE STRONGLY RECOMMEND TRAVEL INSURANCE

Travel protection and insurance, unless specifically noted, is not included in the cost of the client’s itinerary. 

If you elect to purchase travel insurance, the terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances of a pandemic, pre-existing medical conditions, and other policy exclusions. Consult the insurance carriers directly for details. Trip insurance or waivers provided by the supplier may not offer insolvency coverage. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to health hazards including but not limited to Covid-19 or any other claim under the policy.

Please note many adventure destinations such as the Galapagos, African Safaris, etc may require a minimum level of travel insurance. 

A waiver may be required to refuse travel protection. 

The travel advisor may add travel insurance/protection to the booking and send the Description of Coverage to the client. The travel advisor is not authorized to answer specific questions about coverage. It is the client’s responsibility to contact the insurance provider if they wish to clarify the coverage before or after purchasing.  


International Travel

You must have the proper immunizations and health screenings and required documentation of such immunizations and screenings before travel. Far&Low Travel shall not assume responsibility for the accuracy of health, vaccination, or documentation requirements prior to departure or upon landing at the final destination. In some cases, required inoculations must be recorded by Client’s health practitioner on a valid vaccination certificate, which the Client must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the State Department Web site http://travel.state.gov, for relevant information relating to travel to specific destinations, and the Center for Disease Control http://wwwnc.cdc.gov/travel/ relating to health issues related to travel.

The travelers are solely responsible for checking their passport expirations, verifying the entry requirements for their destination, and applying for any necessary visas.  Valid passports are required for all international destinations.

Please note that many destinations require your passport to be valid 6 months after the date of your return. 

Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or prior criminal offense, contact that country directly for entry and exit requirements. You can visit the US State Department Website for further information about these requirements. See, https://travel.state.gov/content/travel.html. We do not inquire about an individual’s criminal record in the interest of respecting our Clients’ privacy. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record or with judgements for unpaid child support should review current entry requirements. Group Travel

When travelers do not live at the same address,  the travel agent will correspond with the initial group leader (the person who made the first contact) throughout the quote process. 

The group leader will be responsible for communicating the details of the quote and/or any agent questions to the rest of the group. 

The travel agent is not responsible for any dissatisfaction with the itinerary by group members: the group leader accepts responsibility for checking the itinerary.  By agreeing to move forward with the deposits, the group leader acknowledges that all parties have been informed of necessary details. 

All quotes assume that travelers will arrive at destinations together.  If travelers arrive separately on different flights,  they will be responsible for the additional cost of airport transfers. 


Last minute travel

Bookings made within 30 days of travel may incur a Rush Planning Fee in addition to any usual Planning Fees. Travel advisor will inform travelers of this fee before moving forward with a quote.  Travelers traveling within the next 30 days may be asked to submit copies of their passport, a client demographic form, and a client intake form before the travel agent moves forward with a quote. 


Cancellation and Non-refundable 

You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through Far&Low Travel. By submitting a credit card authorization form to Far&Low Travel, you agree to allow Far&Low Travel to use your payment method to purchase travel products from our Suppliers on your behalf. Except in cases of fraud, you agree not to file any dispute with your bank or credit card company to avoid or violate any booking terms and conditions of Far&Low Travel or its suppliers, including cancellations or changes of itinerary or arrangements for reasons beyond the control of Far&Low Travel or its suppliers. If you attempt to chargeback, revers or recollect a previously authorized trip payment, Far&Low Travel reserves the right to collect all additional costs, fees, and expenses associated with such chargeback reversal or recollection, including, without limitation, attorney fees. 

All cancellation fees/penalties are from the supplier/vendor/hotel.  It is the traveler’s responsibility to review the terms and conditions on their invoice. 

The traveler agrees that the term “non-refundable” in any quotes, bookings, or invoices means that the booking cannot be refunded under any circumstance, including for reasons of pandemic, war, force majeure, or other unforeseeable events.  The traveler waives their right to sue or institute a credit card dispute or “charge back” to travel advisor or its partners for said penalties, fees, or real or alleged damage related to non-refundable deposits/payments or any other transaction. 

The travel agent does not “keep” payments on behalf of clients.  When a traveler submits a credit card authorization,  the travel agent makes the payment directly to the hotel, cruise, tour, or activity vendor.   The travel agent never receives monies directly from the client except for the Planning Retainer/Service Fee and/or Rush Planning Fee. 

Planning fees paid to Far&Low Travel are non-refundable, but are transferable to a future trip.

By submitting a credit card through our secure link provided by FORA’s Vault, the client agrees to keep a credit card on file.  For your convenience this credit card will be used as a form of payment for fees incurred throughout the booking process. We will notify you before each charge is made. In the event that you have questions, concerns, or dispute a charge to your credit card, please contact Far & Low Travel. directly prior to initiating a refund or “chargeback” with your credit card company. You can request that the card be deleted from our Vault at any time. Doing so means that we will not be able to secure any bookings on your behalf. We will not be responsible for any costs incurred, canceled reservations or any costs associated with not having a card on file.

Check In

Minimum check-in for domestic flights is 1 to 1 ½ hours and for international flights, 2 to 3 hours. It is advisable to arrive at least 2 hours before a domestic flight and 3 hours before an international flight. Refer to your airline for guidelines. Due to heightened security measures, it is advised you allow extra time before scheduled departure. Failure to arrive within your airline's specified time could result in denied boarding. Far & Low Travel bears no responsibility for missed flights.


Limited Liability

Travel advisor is not responsible nor liable for any error, omission, injury, property loss, accident, act of terrorism, disappointment, or any other unforeseeable event. Travel advisor is not responsible for missed connections, schedule changes, aircraft changes, or trip interruption. It is the traveler’s responsibility to have proper travel documents for all trips including but not limited to vouchers, passports, visas, marriage licenses, or birth certificates. Travel insurance should be purchased to protect you in these circumstances. Change and cancel fees may apply. Hotel and tour operator fees may apply at the time of a change or cancellation of existing schedule. PLEASE NOTE: all rates are subject to change without notice until deposit is made.

The travel advisor is not liable for any errors or omis​​sions arising from travelers’ significant delay in responding to requests for necessary information including but not limited to:

  • Airline schedule needed to book appropriate transfers

  • Payment deadlines

  • Customized suggestions for excursions or inquiries if services are needed​

The travel advisor reserves the right to decline to book optional services when information is not received in a timely manner. 

Far & Low Travel and its affiliates, owners, officers, agents, employees, contractors and subcontractors (hereafter in this paragraph “Far&Low Travel”) purchase transportation, hotel accommodations, restaurant services, and other services from various independent suppliers that are not subject to Far&Low Travel’s control. Far&Low Travel nor any associate organization, agent, employee, contractor, or subcontractor shall be held liable for any act, default, injury (including death), loss, expense, damage, deviation, delay, curtailment, or inconvenience caused to or suffered by any person or their property, howsoever arising, which may occur or be incurred by any organization or person, even though such act, default, injury, loss, expense, damage, deviation, delay, curtailment or inconvenience may have been caused or contributed to (a) by the act, neglect or default of Far & Low Travel, owners, officers, agents, employees, contractors and subcontractors, or of any persons for whose acts it would otherwise be responsible, or (b) defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers.

Limitations for Concierge and Optional Services

The travel advisor is not liable/responsible for any reservations the client has made directly with the resort/hotel/tour company/ship, such as: dining reservations, concierge requests, upgraded rooms/airline seats, independently booked tours, private guides, and so on.   In certain circumstances the travel agent may assist with restaurant recommendations and/or limited reservations for special events.  In the event that the traveler cannot attend these events once their trip has begun, the traveler is responsible for contacting the in­-country partner to cancel or change the reservation themselves.    The travel advisor will do her best to assist but is not liable for any cancellation fees or delay in processing changes/cancellations. 

Wherever possible, the travel advisor will attempt to inform the client of any additional costs such as hotel taxes payable upon check in or resort fees.  Hotel taxes may appear on travel vouchers at time of confirmation, and are not always able to be shown during the initial quote.   

The travel advisor is not responsible for any omissions of additional fees during the quote process.  These types of fees include:

  • Gratuities to guides, hotel staff, or drivers 

  • Mandatory onboard service charges/gratuities for cruises 

  • City taxes payable directly at the hotel (very common in Europe)

  • Costs for transport to/from the airport if traveler did not include transfers in quote 

  • Breakfasts or other meals at hotels unless they are specifically included in quote 

Travel advisor is not responsible for any increases due to fuel surcharges, government imposed taxes/fees or supplier-imposed increases.


Privacy Policy / Use of Personal Information 

In this section, “you” refers to the traveler/client and “we” refers to Far&Low Travel 

If you do choose to provide your personal information, we will not willingly share your information with companies outside my organization, except as described in this Privacy Policy. We do not give away, sell, rent or lease any users’ personally identifiable information to any merchant, advertiser or web publisher. 

We reserve the right to disclose personal information when needed to comply with the law or a legal process, cooperate with investigations of purported unlawful activities, to identify persons violating the law, or to enforce my Terms of Use.  You are responsible for reviewing the privacy statements and policies of other websites you choose to link to or from my website, so that you may understand how those sites collect, use and store your information. We are not responsible for the privacy statements, policies or content of any other websites. Websites containing co-branding (referencing my name and a third party’s name) contain content delivered by the third party and not me.

We may use third party applications to manage your information.  Each third-party service provider’s use of your personal information is dictated by their respective privacy policies. We currently use the following third-party service providers

  • FORA Travel, Inc and associated Vault

  • Websites for submitting additional contracts if necessary

  • Hotel, Cruise and tour companies’ direct booking software (examples include, but are not limited to: OneSource with Princess Cruises, CruisingPower with Royal Caribbean, etc).  

  • We must give the tour provider / travel partners your private information such as your name, date of birth, and state of residency in order to complete your bookings.  Your email and/or telephone may also be required by certain travel providers

At this time, your personal information is not shared with any other third-party applications. This list may be amended from time to time. 

 Third Party Performance

Far & Low Travel shall make best efforts to produce successful Services for Client, but Far & Low Travel makes no representations, guarantees, or warranties as to the effectiveness or performance of the Services delivered. Client shall indemnify and hold Far & Low Travel harmless from any and all claims, liabilities, costs, losses, damages, or expenses (including attorney fees) arising from any third-party service provider’s wrongful or negligent acts or omissions. In the event of any changes by third-party service provider that materially affect the delivery or performance of Far & Low Travel’s Services contemplated by this Agreement, Far & Low Travel. shall provide notice to Client and make every effort to work with the Client to find an acceptable alternative to the third-party service provider or find a replacement service at the same or similar cost. If such a situation should occur and a suitable alternative or replacement is not found, responsibility and liability of Far & Low Travel . is limited to the return of payments received for the specific portion of the Services affected. The Client agrees to not unreasonably withhold approval of an alternative.

Satisfaction

The obligation of Client to make payment to Far & Low Travel. according to the terms of this Agreement is not conditioned on Client’s satisfaction with the proceeds of any Services under this Agreement. Client understands and expressly agrees that delivery of the Services under this Agreement shall obligate Client to make payment and payment shall not be withheld due to subjective dissatisfaction.


Acknowledgement Of Risk

You understand and acknowledge that your travel in connection with and participation in the vacation package arranged at your request by Far & Low Travel. may involve risk and potential exposure to injury and possibly death. You also realize and acknowledge that risk and dangers may be caused by the negligence of the owners, directors, employees, contractors, subcontractors, officers, or agents of Far & Low Travel. or the negligence or participation of other participants, contractors, and/or subcontractors to Far & Low Travel. You also recognize and acknowledge that risk and dangers may arise from foreseeable and unforeseeable causes, including weather and other acts of nature, and that the international location of any given trip may be a location where the political, health, cultural and geographical attributes present additional inherent risks greater than those present in Client’s daily life. These inherent risks include, but are not limited to, negative treatment by foreign third parties unaffiliated with Far & Low Travel., as well as the dangers of serious personal injury, death, and property damage resulting from, but not limited to: travel; physical exercise and exertion; physical contact with other travelers or third parties; communicable illnesses, including but not limited to COVID-19; severe allergies; animal or insect-borne illnesses; falling or tripping due to environmental hazards, uneven surfaces, or debris; other health hazards associated with travel; injury or death resulting from exposure to unfavorable weather conditions; and hazards related to dining, including, but not limited to, food sickness, allergic reactions, and/or choking (collectively the “Injuries and Damages”). You fully understand and acknowledge that the aforementioned Injuries and Damages are potential in connection with recreational activities that may take place during your trip.

Client further acknowledges and understands that these Injuries and Damages cannot be entirely eliminated. Client fully understands and agrees that Far & Low Travel. has not tried to contradict or minimize their understanding of these risks. Client understands that Injuries and Damages can occur by natural causes or activities of other persons, environmental circumstances, staff of Far & Low Travel. or third-party service providers, either as a result of negligence or because of other reasons. Client understands that third parties, including third-party service providers, cannot necessarily be controlled, and that Client’s safety, physical health, or emotional wellbeing cannot be guaranteed while traveling and participating in related activities.

It is Client’s responsibility to consult a physician before participating in this trip to ensure eligibility for strenuous physical activity and by signing or otherwise accepting this Agreement, Client affirms that they have no medical conditions that would restrict Client from participating in the journey. Client agrees that if they experience any medical issues while on the trip, they will seek medical treatment immediately.

Researching Your Destination

Far & Low Travel. has no special knowledge regarding any possible unsafe conditions, health hazards, weather hazards, or climate extremes at destinations to which Client may travel. As such, Far & Low Travel. encourages all clients to plan accordingly and do their research in preparing for their travel. For information concerning possible dangers at destinations, please review, at minimum, the Travel Warnings section of the State Department website at www.travel.state.gov. For medical information, contact the Centers for Disease Control at www.cdc.gov/travel. Far & Low Travel. recommends that United States citizens register for the United State’s government’s Smart Traveler Enrollment Program, a free service to allow United States citizens traveling abroad to enroll their trip with the nearest U.S. Embassy or Consulate, at https://step.state.gov/step/.  


Additional Disclosures: 

Travel advisor is not the source or supplier of the travel services requested and acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, ground transportation and other companies providing accommodations, transportations, and/or other services. Each of these suppliers is an independent entity with its own management and is not subject to the travel advisor. 

Travel advisor shall not be liable for any accident, injury, property damage or personal loss to client or to those traveling with Client in connection with any travel services we have booked, including but not limited to acts of God, weather conditions, natural disasters, acts of governments or other authorities, wars, civil disturbances, riots, strikes, epidemics, acts of terrorism, breakdown in equipment, theft, delay, fuel increases or cancelation or change in intermarry or schedules. 

Client acknowledges and accepts that there are canceling policies, change fees and penalties that apply to my travel plans and services as set by travel suppliers. If for any reason credit card charges are later declined, reversed or travel advisor is unable to receive payment for the travel plans and services, the client acknowledges that this is a binding contract and travel advisor will be entitled to recovery, including reasonable attorneys’’fees in connection with collection.

The Terms & Conditions are subject to be updated for reasons including but not limited to changes in law. 

By booking any part of a trip with Far&Low Travel and/or paying the planning fee, you (the client) acknowledges that you have read and accept the Terms & Conditions for yourself and anyone in your party.
